Probate is the legal process through which a deceased person’s assets are distributed, and their final affairs are settled. In Florida, the probate process can be categorized into two main types: formal administration and summary administration.
Formal administration is Florida’s most common type of probate. It is required in cases where the value of the estate exceeds $75,000 or if the decedent has been deceased for more than two years. Key features of formal administration include:
Appointment of a personal representative: The court appoints a personal representative, commonly referred to as an executor, to administer the estate’s affairs.
Notice to creditors: The personal representative is responsible for providing notice to creditors, allowing them to file claims against the estate.
Formal asset inventory: A detailed inventory of the estate’s assets and liabilities is prepared.
Court supervision: The court oversees the probate process, ensuring compliance with legal requirements.
Summary administration is an expedited probate process available for small estates or when the decedent has been deceased for less than two years. Key features of summary administration include simplified process: Summary administration involves a simplified procedure, allowing for a faster distribution of assets. No formal asset inventory: Unlike formal administration, a detailed asset inventory is not required. However, the court may request a summary of the estate’s assets.
Limited court supervision: Summary administration involves less court supervision, streamlining the probate process.
